  9. GENERAL PROVISIONS
    1. The https://www.howsmart.pl/ website operates under the terms and conditions set out in these Regulations.
    2. The Regulations specify the types and scope of services provided electronically by the https://www.howsmart.pl/ website, the rules for the provision of these services, the conditions for the conclusion and termination of agreements on the provision of services electronically, as well as the complaint procedure.
    3.     4. Each Customer, as soon as he/she starts to use the Electronic Services of the https://www.howsmart.pl/ website, is obliged to comply with the provisions of these Regulations.
    5. In matters not covered by these Regulations, the provisions of the
      1. Act on provision of services by electronic means of 18 July 2002 (Journal of Laws No. 144, item 1204 as amended),
      2. The Consumer Rights Act of 30 May 2014. (Journal of Laws 2014 item 827),
      3. Civil Code Act of 23 April 1964 (Journal of Laws No. 16, item 93 as amended) and other relevant provisions of Polish law.
    6. DEFINITIONS
      1. CONTACT FORM - a form available on the Website https://www.howsmart.pl/ enabling the Service Recipient to contact the Service Provider directly.
      2. TERMS AND CONDITIONS - these rules and regulations of the Site.
      3. SERVICE PROVIDER - HowSmart Sp.z.o.o with its registered office in Warsaw, ul.Gubinowska 4/77, 02-956 Warsaw, entered in the KRS register: 0000870772 , NIP:9512510878, REGON:387615546, e-mail address: biuro@howsmart.pl, tel.
      4. USER - a natural person, a legal person or an organisational unit without legal personality, which is granted legal capacity by law, using an Electronic Service.
      5. ELECTRONIC SERVICE - a service provided electronically by the Service Provider to the Customer via the Website.
      6. NEWSLETTER - Electronic Service allowing the Customer to subscribe to and receive free information from the Service Provider at the e-mail address provided by the Customer.
    7. TYPE AND SCOPE OF ELECTRONIC SERVICES
      1. The Service Provider enables through the Site the use of Electronic Services such as:
        1. use of the Contact Form,
        2. use of the Newsletter,
      2. The provision of Electronic Services to Service Recipients takes place under the terms and conditions set out in the Terms and Conditions.
    8. TERMS AND CONDITIONS FOR THE PROVISION AND CONCLUSION OF CONTRACTS FOR ELECTRONIC SERVICES
      1. Provision of the Electronic Services specified in Chapter III pt. 1 of the Regulations by the Service Provider is free of charge.
      2. The period for which the contract is concluded:
        1. The contract for the provision of Electronic Services consisting of enabling the sending of a message via the Contact Form is concluded for a definite period of time and is terminated as soon as the message is sent or the Service Recipient stops sending it.
        2. The agreement for the provision of Electronic Services consisting of the use of the Newsletter is concluded for an indefinite period of time.
      3. Technical requirements necessary to work with the ICT system used by the Service Provider:
        1. a computer with Internet access,
        2. access to e-mail,
        3. web browser,
        4. enable Cookies and Javascript in your web browser.
      4. The Customer is obliged to use the Site in a manner consistent with the law and good morals, with due regard for the personal rights and intellectual property rights of third parties.
      5. The customer is obliged to enter factually correct data.
      6. The recipient is prohibited from providing unlawful content.
    9. CONDITIONS FOR THE TERMINATION OF E-SERVICE CONTRACTS
      1. Termination of the Electronic Service Agreement:
        1. A contract for the provision of an Electronic Service of a continuous and unlimited nature (e.g. use of the Newsletter) may be terminated.
        2. The customer may terminate the contract with immediate effect and without stating reasons by sending an appropriate statement by e-mail to the following address: biuro@howsmart.pl.
        3. The Service Provider may terminate the contract for the provision of Electronic Services of a continuous and indefinite nature in the event that the Customer violates the Terms and Conditions, in particular when he/she provides content of an unlawful nature, after an ineffective prior request to cease violations with the setting of an appropriate period of time. In such a case, the Agreement shall expire 7 days after the submission of the declaration of intent to terminate the Agreement (notice period).
        4. Termination leads to the termination of the legal relationship with effect for the future.
      2. The Service Provider and the Customer may terminate the contract for the provision of Electronic Services at any time by mutual agreement.
    10. COMPLAINT PROCEDURE
      1. Complaints relating to the provision of Electronic Services by the Service Provider:
        1. Complaints relating to the provision of Electronic Services via the Site may be made by the Customer via e-mail to: biuro@howsmart.pl.
        2. In the above-mentioned e-mail message, please provide as much information and circumstances as possible about the subject of the complaint, in particular the type and date of the irregularity and your contact details. The information provided will greatly facilitate and expedite the handling of the complaint by the Service Provider.
        3. The Service Provider shall deal with the complaint without delay, no later than within 14 days.
        4. The Service Provider's response to the complaint shall be sent to the Client's e-mail address specified in the complaint or by any other means specified by the Client.
      2. INTELLECTUAL PROPERTY
        1. All content posted on the website at https://www.howsmart.pl/ enjoys copyright protection and is the property of https://www.howsmart.pl/ The Customer shall be fully liable for any damage caused to the Service Provider resulting from the use of any content of https://www.howsmart.pl/, without the consent of the Service Provider.
        2. Any use by anyone, without the express written consent of the Service Provider, of any of the elements comprising the content and contents of the https://www.howsmart.pl/ website constitutes an infringement of the Service Provider's copyright and will result in civil and criminal liability.
      3. FINAL PROVISIONS
        1. Contracts concluded through the Site shall be concluded in accordance with Polish law.
        2. If any part of these Terms and Conditions is inconsistent with applicable law, the relevant provisions of Polish law shall apply in place of the challenged provision.
